Digital Millennium Copyright Act

It is the policy of bwconnect™ to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (the “Act”) -- the text of which can be found at http://www.copyright.gov/legislation/dmca.pdf -- and other applicable intellectual property laws. What follows below is the procedure for submitting proper notices under the Act, set forth in a manner as to make the process as straightforward as possible. The form of notice of alleged infringement specified below is consistent with the Act. It is the policy of bwconnect™ to (1) block access or remove material that we believe in good-faith to be copyrighted material that has been illegally copied and distributed by any of our suppliers; and (2) remove and discontinue service to repeat offenders. If we remove or disable access to material to comply with the Act we will make a good-faith attempt to contact the owner, author, or administrator of each affected site or content so that they may make a counter notification pursuant to sections 512(g)(2) and (3) of the Act. It is our policy to document each notice of alleged infringement and counter notification on which we act. A copy of each notice of alleged infringement and counter notification may be sent to a third party who will make it available to the public (such as http://www.chillingeffects.org).

Below is the process for filing a notice of alleged infringement and a counter notification:

Infringement Notification

To file a notice of alleged infringement with bwconnect™ you must strictly comply with these instructions. Please be advised that you may be liable for damages (including costs and attorneys’ fees) if you materially represent that any material or content is infringing your copyright. If you are not certain whether the material or content is infringing your copyright, you should consider consulting with an attorney before filing your notice.

If you believe that material or content residing on or accessible through our website infringes your copyright, please send a notice of alleged infringement by providing a written communication (by fax or regular mail -- not by email, except by prior agreement) that sets forth the items specified below.

To expedite our ability to process your request, please use the following format (including section numbers):

  1. Identify in sufficient detail the copyrighted work that you believe has been infringed. For example, "The copyrighted work at issue is an image of a carved swan that appears on [insert web page link to copyrighted work or otherwise provide sufficient information to specify the copyrighted work being infringed]."
  2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above, including information regarding the location of the infringing materials on our website that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence.

    You must identify each search result that directly links to a web page that allegedly contains infringing material. This requires you to provide (a) the search query that you used, and (b) the URL for each allegedly infringing search result.

    For example, suppose (hypothetically) that you conducted a search on bwconnect™ using the query "duck", and found that the second and fifth results directly link to a web page that you believe infringes your copyrighted material which you identified in item #1 above. In this case, you would provide the following information:

  3. Provide information reasonably sufficient to permit bwconnect™ to contact you, including address, telephone number and, if available, email address.
  4. You must include the following statement: "I have a good-faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."
  5. You must include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. You must sign the notice of alleged infringement.
  7. You must send the written communication to the Designated Agent (by fax or regular mail – not by email) to the following:

Once a proper notice of alleged infringement is received by our Copyright Agent, it is our policy: (1) to remove or disable access to the infringing material or content; (2) to notify the supplier that we have removed or disabled access to the material; and (3) that repeat offenders will have the infringing material removed from the system and that we will terminate such supplier’s access to our service.

Counter Notification

To file a counter notification with bwconnect™ you must strictly comply with these instructions. Please be advised that you may be liable for damages (including costs and attorneys’ fees) if you materially represent that any material or content is infringing the copyright of another. If you are not certain whether the material or content is infringing the copyright of another, you should consider consulting with an attorney before filing your notice.

If the supplier believes that the content or material that was removed or to which access was disabled is either not infringing, or that it has the right to use such content or material from the copyright owner, the copyright owner's agent, or pursuant to the law, the supplier may send a counter notification pursuant to the Act.

To file a counter notification with us, you must provide a written communication (by fax or regular mail -- not by email, except by prior agreement) that sets forth the items specified below.

To expedite our ability to process your counter notification, please use the following format (including section numbers):

  1. Identify the specific URLs at which the allegedly infringing content or material appeared before bwconnect™ removed or disabled access to such content or material, and identification of the content or material that we removed or to which we has disabled access.
  2. Provide your name, address, telephone number, e-mail address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or the County of New York, New York if your address is outside of the United States), and that you will accept service of process from the person who provided notification of the alleged infringement.
  3. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that each search result, message, or other item of content identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  4. You must sign the counter notification.
  5. You must send the written communication to our Copyright Agent (by fax or regular mail – not by email) to the following:

When a counter notification is received by our Copyright Agent, we will make a good-faith effort to send a copy of the counter notification to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the supplier, the removed material may be replaced or access to it restored in 10 to 14 business days after receipt of the counter notification.

While bwconnect™, has not self-certified for the Safe Harbor, it does seek to incorporate the Principles in its Privacy Policy and adhere to the standards of the Principles. NOTICE - Information bwconnect™, collects and how it is used

bwconnect™, will ask you for personal information because it allows us to deliver a superior level of customer service. It enables us to give you convenient access to our products and services, provide you with a more efficient Site experience, and focus on products and services of greatest interest to you.

Except as set forth in this Privacy Policy, bwconnect™, does not sell, rent, share, or otherwise distribute your personal information to any other organization, company, or other entity.

Personal Information: When you register to become an Authorized User with bwconnect™, we will ask you for your personal information (which will include your name, contact information, company information, and tax and reseller identification). Your personal data is used by bwconnect™, and its affiliates only for the process of reviewing your application for approval, in the transaction of business with you and your company. Because we respect your privacy, bwconnect™, and its affiliates do not distribute marketing information with contact information.

We use your personal information in the following ways:

  1. To verify your status and approve your application as an authorized reseller;
  2. To confirm and fulfill your orders -- initiate purchase orders on your behalf
  3. To provide you with copies of the invoices for your purchases.
  4. To communicate directly with you and provide personalized customer service should the need arise;
  5. To keep a record of your purchases over time; and
  6. To compile a profile of product categories and other buying patterns so, as you continue to purchase through bwconnect™ and its affiliates, we will be able to provide you with an increasingly personalized shopping experience.

B. Anonymous Data: As is true with most websites, we collect some information automatically on your use of the Site (such as Internet Protocol addresses, browser type, Internet Service Provider, referring/exit pages, operating system, date/time stamp and clickstream data). This includes which pages are visited and types of products viewed and purchased. This information does not identify you as an individual. We then aggregate this information with information from Site visits of thousands of other users for our use in improving the Site and our product offerings and making your experience on the Site as valuable and efficient as possible. This anonymous statistical data may from time to time also be shared with other related parties. Again, your name and contact information will not be attached to this statistical data. We will not use this information to market directly to you.

C. Communications: In the normal course of business, we will communicate with you or you may communicate with us by email, telephone or other means with reference to your orders (confirmations, invoices, etc.), product or service inquires, customer service issues, such issues as security, general announcements, and/or changes to bwconnect™ Privacy Policy, changes to the Site, new features or services, and new product information. We may retain all such communications so that we may optimize our service to you. When we advise you of new products and services, news or events by email, you will be given the option not to receive such notices in the future, or you may at any time update your personal settings by clicking on My Account page and changing your personal preferences.

E. Cookies: bwconnect™ uses cookies to authenticate registered users of our Site. Cookies are tiny text files that are stored on your computer and allow us to remember what is in your shopping basket and to remember you when you return to the Site. Cookies do not harm your computer and do not contain any personal or private information. CHOICE - Opt Out

When you register to become an Authorized User with bwconnect™, we will ask you for your personal information so that you can set up an Account and conduct transactions on our Site. We will use your personal information only as stated in this Policy. If we wish to use your information in a manner different than the purpose for which we collected it from you, then we will ask for your consent prior to such use. You can decline to submit personal information to us at any time, in which case we may not be able to provide certain services to you.

ONWARD TRANSFER - Information Sharing

bwconnect™ only shares personal information with other companies or individuals that are not affiliated to us in the following limited circumstances:

A. We have your consent. We require opt-in consent for the sharing of any sensitive personal information.

B. We provide sensitive personal information to trusted businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.

C. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Bwconnect™, its users or the public as required or permitted by law.

We may use third party advertising companies to serve ads on our behalf. We do not provide any personal information to these advertisers or third-party websites. These third-party websites and advertisers, or Internet advertising companies working on their behalf, sometimes use technology to send (or "serve") the advertisements that appear on our Site directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalize advertising content. We do not have access to or control over cookies or other features that they may use, and the information practices of these advertisers and third-party websites are not covered by this Privacy Policy but rather their own policies.

bwconnect™ takes appropriate security precautions to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. These safeguards include administrative, technical, and physical measures.

bwconnect™ is an advocate of the use of technology to keep your personal information private and secure. Our web servers use the SSL (Secure Socket Layer) protocol to encrypt data sent to and from your web-browser. This includes all personal information you provide us in your application as well as credit card information provided at the time of purchase. Failure of our employees to adhere to company guidelines regarding the safeguarding and handling of personal information may subject them to disciplinary action, up to and including termination and criminal prosecution.

bwconnect™ processes personal information only for the purposes for which it was collected and in accordance with this Policy. We strive to ensure that our data collection, storage and processing practices collect, store and process only the personal information needed to provide you with our Site services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current. However, it is up to you, our Site user, to update and correct your personal information as necessary to maintain its accuracy.

ACCESS

We provide you with access to your personal information to correct, amend or delete your information where it is inaccurate, except where such action requires disproportionate cost or effort by us or jeopardizes the rights of others. You can access your personal information that you have provided to us simply by clicking on My Account page to access your account.

ENFORCEMENT

You always have recourse to us should you have any questions or concerns about our Policy, or our compliance with it. bwconnect™ cooperates fully with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to release information about users whom we believe to be in violation of our guidelines. We also reserve the right to report to law enforcement agencies any activities that we reasonably believe to be unlawful.

Changes to this Privacy Policy

bwconnect™ reserves the right to amend, modify, delete, or cancel any of part of this Privacy Policy, without advance notice, at any time. All such amendments will be published on the Site. The version of this Privacy Policy in effect at the time of a transaction will govern our relationship through the course of that transaction.
